EWHC adjourns enforcement of Award requiring specific performance despite absence of formal application from defendant
In a decision dated 7 July 2022, in the case of Consilient Health Ltd v Gedeon Richter PLC, the High Court of Justice (the Business and Property Courts of England and Wales) decided to adjourn the enforcement of a binding award in favour of the Claimant rendered by an arbitral tribunal in an ICC arbitration based in the Netherlands.
This is the first case in the United Kingdom deciding on the adjournment of an award ordering specific performance of obligations.
