SCC Arbitration Tribunal upholds Spain’s intra-EU jurisdictional objection to Danish investors’ claims under the Energy Charter Treaty

On 16 June 2022, a Stockholm Chamber of Commerce Arbitration Tribunal determined that it lacked jurisdiction to hear Green Power Partners and SCE Solar Don Benito’s claims for EUR 74 million in compensation following Spain’s alleged violation of the Energy Charter Treaty and international law.
