What the CJEU said about its jurisdiction in Republic of Moldova v Komstroy

The CJEU asserted jurisdiction over international agreements forming an integral part of the EU’s legal order (i) concerning situations arising after a Member State’s accession to the EU, (ii) where it is in the EU’s interest that such international agreements be interpreted uniformly, and (iii) concerning disputes subjected to EU law through the selection of an arbitral tribunal seated in a Member State – even in the context of disputes involving the investor of a non-Member State and another non-Member State.
